The Great Division: Division 40 vs Division 43

Maximising property depreciation deductions requires a clear understanding of how the different parts of a rental property qualify for Division 40 or Division 43. A property depreciation report needs to be structured so that deductions are maximised and accelerated when needed. This is achieved by creating an effective balance between assets that qualify for Division 40 and Division 43. Here at BMT Tax Depreciation our job is to identify as many items as possible that will depreciate at a faster rate. Creating this balance will magnify a property investor’s deductions, putting more cash into their pockets sooner.

Division 40
Division 40 is the legislation that covers the depreciation of ‘plant and equipment’, i.e. the removable fixtures and fittings within an investment property. Each plant and equipment item has an effective life set by the Australian Taxation Office (ATO) and the depreciation deduction available on that item is calculated using this effective life.Some of the Division 40 items commonly found within a property include: 

  • hot water service     
  • ovens                  
  • vinyl                            
  • ceiling fans            
  • furniture        
  • floating timber floors                  
  • dishwashers            
  • rangehoods         
  • clothes dryers      
  • carpet                                        
  • smoke alarms                             
  • freestanding spa            
  • blinds                                          
  • air conditioners              
  • curtains                                       
  • exhaust fans
  • light shades
  • security systems             
  • washing machines
  • microwaves                                
  • cooktops                                   
  • solar panels                                
  • garbage bins
  • bathroom accessories                
                                  

Division 43 

Otherwise known as ‘Capital Works Allowance’ or ‘Building Write-Off’, Division 43 covers the deduction available to owners for the structural elements of a building and the items within the property that are deemed irremovable. It includes the foundations, walls, ceiling, roof and also includes fixed assets like tiles, toilets, built-in cupboards, windows and doors. Properties qualify for this allowance depending on their age and type; either 2.5% or 4% of a property’s historical construction cost or estimated cost can be claimed by a relevant professional such as a Quantity Surveyor.

The Great Division
The main difference between Division 40 and Division 43 is that Division 40 items depreciate faster. For example, while the building structure (Division 43) can be claimed at a rate of 2.5% over 40 years, carpet (Division 40) in a residential property depreciates at a rate of 20% over 10 years (using the diminishing value method).

Some items can create confusion when categorising them into a Division 40 or Division 43 deduction. For example, an air conditioning unit will fall under Division 40,

whereas the ducting throughout the house for the same air conditioner falls under

Division 43. A swimming pool falls under the Division 43 allowance, however, the pumps for the pool qualify for Division 40.  

When these assets are not classified properly, money is lost in the first 5 financial years. We often see the obvious assets classified as Division 40 and the more inconspicuous items sometimes missed. This means they get combined with Division 43 and claimed at 2.5% rather than the much higher rate based upon their effective life, which could mean a difference of thousands of dollars in the property investor’s pocket.

Protect your Tax File Number

Your tax file number (TFN) is used to identify you in your dealings with the Australian Taxation Office and will usually stay the same for life. It's an important part of your identity and should be kept safe.

Never quote or give out your TFN unless there is a good reason, such as completing a tax form or opening a bank account.

Only certain people are entitled to ask for your TFN including the Australian Taxation Office, Centrelink, your superannuation fund, bank or financial institution, and your employer (but only after you have started working for them).

Your TFN should never be used to establish or confirm your identity with other organisations.

2011 Budget Highlights

We thought we would give a very brief summary of the main announcements affecting our clients flowing from the 2011 Federal Budget.

Individuals and Families
         

    
  • Personal Tax Rates have not changed.
  • Family Tax Benefit A has been increased for families with children from 16 to 19 years of age. This is a Centrelink adjustment only.
  • Family Tax Benefits will not be increased by the inflation (CPI) rate for the next 3 years.
  • Minors (under 18) are no longer entitled to the low income tax rebate. This means income over $416 on unearned income is taxed from 1 July 2011.
  • The Dependant Spouse Tax Offset related to a non working spouse under 40 years of age with no children has been removed from 1/7/2011.
  • There are no deductions permitted against all government assistance payments (e.g. Austudy) effective from 1 July 2011.
  • HECS upfront payment discount has been reduced from 20% to 10% from 1/1/2012. Voluntary payments above $500 receive 5% bonus discount instead of 10%.

Small Business

  • Immediate deduction of $5,000 for new motor vehicles used for business purchased from 1 July 2012.
  • The Entrepreneurs Tax Offset for small business is being abolished from 1 July 2012.
  • FBT on company vehicles is now a flat rate at 20% of car cost, using the statutory formula method.  New rate is to be phased in over 4 years except new cars are 20% from budget night.
  • Trust Distributions to minors with zero tax was $3,333 due to Low Income Tax Offset. Effective 1/7/2011 this has been removed and the maximum untaxed distribution benefit is now only $416.
  • Corporate tax rate of 29% from 1/7/2013 for small business entities.
  • Businesses in Building & Construction industry must report contractor payments by ABN from 1/7/2012

Superannuation

  • For account based pensions, reduction in the minimum pension payment amounts by only 25% in 2011/12 and will return to normal in 2012/13.
  • SMSF levy to rise from $150 to $180 for year ended 30th June 2011.
  • New SMSF auditor registration fees from 1/7/2012.
  • Excess Contribution once off allowance of $10,000 from 2011/12 year taxed at individual marginal rates.
  • Higher superannuation concessional contribution cap of $50,000 for members over age 50 after 1/7/2012, applies only to members with less than $500,000 superannuation balance.
  • Employer super payments on pay slips from 1/7/2012.
  • Director Penalty regime to incorporate Super Guarantee obligations from 1/7/2011.

Beware of Scammers!

Scammers claiming to represent the Australian Taxation Office (ATO) are ringing and emailing people to offer refunds in exchange for transferring cash to a charity.

Scam callers may be able to quote detailed knowledge of their victim’s personal details such as address, date of birth and private contact numbers.

Some scammers claim to be from the ATO's Grant Department and promise a hand-delivered cheque if their victim will confirm their address and make a phone call to transfer money to India.

The ATO does not ring people to notify them of unclaimed tax refunds, nor will they ask people to transfer cash before their refund will be paid out.

Flood Levy Announced

Flood Levy Announced

The Government has just announced an increase to the Medicare Levy threshold to help pay for the flood recovery process.

Applying from the 2011/2012 income year, the flood levy of 0.5% will apply to all taxpayers with a taxable income of $50,000 or more and 1% for all those with an income above $100,000. Those below the income threshold or who are in receipt of an Australian Government Disaster Recovery Payment for a flood event that occurred during the 2010/2011 income year will be exempt from paying the flood levy. The levy is intended to apply to the 2010/2011 income year only.

The flood levy will be applied to the Medicare Levy this suggests that the levy will not be imposed on non-resident taxpayers although this is yet to be confirmed.

Pay As You Go (PAYG) Instalment taxpayers will have the levy charged in their PAYG instalments. People who received an Australian Government Disaster Recovery Payment can seek a variation to their instalment payment so that they don’t have to pay the levy. The ATO is also investigating the possibility of automating PAYG Instalment amounts so that people who don’t have to pay the levy are not charged an amount in their PAYG instalments.

Employees who are exempt from the levy should ask their employer to not have the levy withheld from their regular pay with other tax withheld. Alternatively, at the end of the year the ATO will assess taxpayers’ tax liability taking into account the exemption from the levy.


Paid Parental Leave

Paid Parental Leave

On 1 January 2011, the Federal Government Paid Parental Leave Scheme commenced. This Australia-wide Scheme is designed to provide eligible employees who give birth to or adopt a child from that date with up to 18 weeks pay at the national minimum wage.
While eligible working parents need to apply directly to the Government Family Assistance Office for the payments, Australian employers will be directly affected in several ways:
  • eligible employees need to apply for and be granted leave by their employers;
  • employers need to adapt their payroll systems by 1 July 2011 to make the payments to eligible staff on behalf of the Family Assistance Office; and
  • any employers currently providing paid parental leave benefits to staff will need to understand if they are obliged to continue to pay these benefits in addition to the Government Scheme.
As the Family Assistance Office is already taking applications, employers with potentially eligible staff can expect to be approached with questions about the Government Scheme and company’s various leave policies.
